In consideration of your use of Photohugs services, you agree to provide accurate, current and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); maintain the security of your password and identification; maintain and promptly update the Registration Data, and any other information you provide to Company, to keep it accurate, current and complete; and be fully responsible for all use of your account and for any actions that take place using your account.

A condition of Membership is your "Active Participation" in the Service. Active Participation is defined as purchasing photo merchandise, including prints and enlargements, through the Service at least once every 365 days. If you cease Active Participation for any reason, Photohugs may terminate your Membership (or any part thereof) and your use of the Service, and may remove and discard all information, communications, postings, albums, image files, creative material, photographs, links, comments, and other content (collectively "Content") uploaded by you or otherwise made available by you within the Service.
Photohugs is committed to ensuring that the Service remains a fun and safe place to Process photographs. To that end, the Service allows Members to be creative with their "Content". To make Photohugs a safe place, users of the service, whether or not Members, may not use the Service to process prohibited content. Photohugs believes the following content or other material as prohibited content:
Photohugs has the sole discretion to determine whether Content is Prohibited Content, and any Content submitted to the Service may be subject to examination from time to time. Although Photohugs does not and will not examine or otherwise review all Content submitted or transmitted to the Service, Photohugs may delete, move, and edit Content for any reason, at any time, without notice.
All Content (whether private or public) that is Processed on the Site is the sole responsibility of the person who submitted it. Thus, you are responsible for your Content.
By viewing the Site, you may be exposed to Content that you consider to be offensive. You take sole responsibility for such exposure.
Photohugs in no way guarantees the accuracy, quality or appropriateness of Content available through the Service.
Photohugs offers free, unlimited storage of online photos to Members who maintain Active Participation. There is no limit to the Content you can upload. When you upload image Content to the Service, the original resolution of your Content may be affected depending on the upload speed you choose. Further, high resolution images, Photohugs may in its discretion down-sample the image regardless of the upload speed you choose.
You should always preserve your original Content, or make back-up copies of such Content, on your personal system. You should not use the Service as the only repository or other source for your Content.
However, to enjoy unlimited storage space the user has to make purchase at least once every 365 days. Photohugs reserve the rights to delete or restrict user storage space without any notice or announcement, disregard to the user participation.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Site or the Service ("Submissions"), provided by you to Company are non-confidential and shall become the sole property of Company. When you use the Service, you become a participant in an online community of people who enjoy photography. In order for Photohugs to make your photos available to you and your invitees, as well as to use images to offer you a special variety of online services, Photohugs needs the rights to make use of all Content on the Service, in accordance with and subject to these Terms. Accordingly, as a condition to your Membership, you hereby grant Photohugs exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Basic membership to the Service is free. Certain content, products or services on the Site, such as photo printing, photo gifts, and membership upgrade plans are subject to charges and specific terms and conditions, which are explained in connection with such content and services. Photohugs may, at its discretion, elect to modify, delete, reduce, augment, or discontinue the Service or any product, service, feature, functionality on the Site
While we strive to provide accurate product and pricing information, pricing or typographical errors may occur. Photohugs cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Photohugs shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is mispriced, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. The prices mentioned in the website are in domination of American Dollars and will be distinctly specified for any other domination. Prices in the website do not cover the shipping charges. The shipping charges will be added to the bill in the ordering process based on the destination specified.
All the orders placed during the ordering process using our services may be accepted. However during the processing of your order or during the delivery, if it comes to our notice that the order placed is not adhering to the terms and conditions imposed, we have the right to cancel the order and a notification will be sent to you with regard to this. Photohugs reserve the right to cancel any order at any time without notification.
The dates specified in the delivery order are for estimation and the actual date may vary subjectively. However we will try our best to process your delivery in the stipulated time. There might be delays due to unforeseen reasons. Under any such circumstances Photohugs is not responsible for the delays. We are also not responsible for delivery at wrong address(es) in cases where incorrect addresses are specifies at the time of placing the order.
In case you are not satisfied with the quality or the services provided by us you can contact our customer care service at support@photohugs.com within 15 days of the date of receipt. The customer service is accessible 24*7.
For payments to be made we or the authorized payment agency may ask you to provide your credit card information which includes your credit card number, expiration date, billing address and any other information which will help enhance the security of the transaction to prevent fraudulent transactions. The information provided by you will not be stored for any reason in our database.
Photohugs offers a feature whereby Users of the Site can share with others or post to their own member profile, pictures and other Third Party Content from, and/or links to, Third Party Sites through the Service (the "Share Service"). You acknowledge and agree that your use of the Share Services and all links, User Content or Third Party Content shared through the Share Service is subject to, and will fully comply with the User conduct rules set forth above and the other terms and conditions set forth in these Terms of Use.
You are solely responsible for your interactions with other Photohugs Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users.
Your use of the Service may be for personal purposes only. You will not (i) reproduce, duplicate, copy, sell, resell or exploit any part of the Service, or (ii) use or access the Service for any commercial purpose.
As a convenience to Members, Photohugs may make third-party software available through the Service. To use such software, you will agree to the terms and conditions imposed by the third party provider. The agreement to use such software will be solely between you and the third party provider.
Photohugs makes no representations or warranties concerning, and is not liable or responsible in any manner for, any performance, effectiveness or other aspect of such software.
It is Photohugs policy to report suspected illegal activities to law enforcement agencies and to cooperate fully with their investigations
Photohugs have made every effort to display the colors of images that appear on the Site as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.
Photohugs uses the best technology available to print digital images for the ultimate quality and service. However, Photohugs will not guarantee on the quality of the pictures printed. If the printed pictures are considered of bad quality by the user and Photohugs together, then either the pictures are reprinted for free of cost or the money is reimbursed upon the user will.
YOU WILL INDEMNIFY, DEFEND AND HOLD HARMLESS PHOTOHUGS, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, SUPPLIERS, INFORMATION PROVIDERS, AND AGENTS (COLLECTIVELY "PHOTOHUGS AFFILIATES") FROM AND AGAINST ALL LOSSES, CLAIMS, LIABILITIES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEYS' FEES, RESULTING FROM ANY VIOLATION OF THESE TERMS OR ANY ACTIVITY RELATED TO THE SERVICE (INCLUDING NEGLIGENT OR WRONGFUL CONDUCT) BY YOU OR BY ANY OTHER PERSON ACCESSING THE SERVICE AS YOUR INVITEE, SUCH AS BY USING YOUR ACCOUNT.
Photohugs or its affiliates are not responsible or liable in any manner for any User Content or Third Party Content posted on the Site or in connection with the Service, whether posted or caused by Users of the Site or by any of the equipment or programming associated with or utilized in the Site or the Service. Although we provide rules for User conduct and postings, we do not control and are not responsible for what Users post on the Site and are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the Site or in connection with any User Content or Third Party Content. If you object to any portion of this Agreement, or any subsequent modification thereto, or become dissatisfied with the Service, the Site, or any materials, data, text, images, video, audio, music, sound or other Site Content, or any transaction entered into through the Site or Service, your only recourse is to immediately discontinue use of the Service and notify Photohugs of such termination. The preceding sentence sets forth your sole and exclusive remedy regarding any objection to the terms of this Agreement, or any dissatisfaction with the Service or the Site.
Photohugs reserves the right, in its sole discretion, to terminate all or a portion of the Service at any time and for any reason.
Photohugs reserves the right, in its sole discretion, to terminate your Membership in the Site, or to remove your Member Content (including unlisted, password protected and unassigned Member Content) or to edit, delete or remove any postings from the Site without prior notice for any reason or no reason in its sole discretion
Any termination under any provision of this Agreement may be effected without prior notice, and Photohugs may immediately delete and discard all of your Member Content, and/or bar any further access to such files on the Site or through the Service. Upon any termination of your Membership, or of this Agreement, your right to use the Service will immediately cease. Photohugs will have no obligation thereafter to host or provide access to your Member Content, or to forward any materials stored through the Service or any unread or unsent messages. Photohugs may retain certain content /materials for administrative and other reasons.
